Buffalo Bills fans woke up Sunday morning to the news that star defensive tackle Ed Oliver had been arrested Saturday night in Houston and charged with driving while intoxicated and unlawfully carrying a weapon.

Not the news fans, whose team is positioned to contend for the AFC East title in 2020, wanted to read before their morning coffee.

So what type of punishment is Oliver facing when football finally does return?

New York Jets tight end Chris Herndon was suspended four games last season for violating the league’s substance abuse policy. He was arrested in June of 2018 on a DWI and was involved in a two-car crash that resulted in property damage.

ESPN’s Rich Cimini wrote: “According to the league’s alcohol policy, a first-time offender gets a minimum two-game suspension but can receive additional discipline if NFL commissioner Roger Goodell determines there were aggravating circumstances, including extreme intoxication, property damage or serious injury to the player or another party.”

Oliver allegedly was failing to maintain a lane and driving dangerously in a 45 mile-per-hour construction zone when a call was placed to the police, first reported by the Montgomery County Police Reporter. Here’s more: “A Montgomery County Sheriff’s Deputy was able to locate the vehicle and stop it on SH 242 near FM 1485. He then requested a DWI Certified Officer to the scene. The driver of the vehicle did have an open beer between his legs and appeared nervous.”

Police found a gun while searching Oliver’s vehicle.

Herndon went on to play the entire 2018 season as a rookie before ultimately missing four games to start the 2019 season. Oliver will likely also face a suspension at some point but it’s difficult to predict when it’ll be.

WKBW-TV’s Josh Reed pointed out that Oliver could be suspended three games.

Under their violations of law involving alcohol, the NFLPA website says “Absent aggravating circumstances, discipline for a first offense will be a suspension without pay for three regular or postseason games.”

The Bills released a statement early Sunday morning on Oliver’s arrest: “We are aware of the situation and we are gathering more information. We will have no further comment at this point.”

The Bills allowed defensive tackle Jordan Phillips, who led the team in 2019 in sacks (9.5), to leave in free agency. He signed a three-year deal with the Arizona Cardinals, vaulting Oliver to the top of the depth chart at the position. After glimpses of high-end production in 2019, Oliver has widely been mentioned as a breakout candidate in 2020 for a Bills defense that should be one of the best in the league.

Oliver was one of four NFL players that were arrested this week. Giants cornerback DeAndre Baker was arrested this week on four counts of armed robbery with a firearm and four counts of aggravated assault with a firearm. Seattle Seahawks cornerback Quinton Dunbar was charged with four counts of armed robbery. Washington receiver Cody Latimer faces assault and weapons charges after an arrest this week.
